Privacy Policy

This Privacy Policy explains how Fashionable, Inc., doing business as Fashionable Canes ("we," "us," or "our"), collects, uses, and shares your personal information when you visit or buy from fashionablecanes.com (the "Site"). "Personal information" means any information that can identify you.

What we collect

• Device information: Your browser version, IP address, time zone, cookie information, the pages and products you view, search terms, and how you use the Site. This is collected automatically through cookies, log files, web beacons, tags, and pixels. We use it to load the Site correctly and to understand how it's used. It's shared with our service providers Shopify and Klaviyo, and with advertising partners as described in Advertising and pixels.
• Order information: Your name, billing and shipping address, payment information, email address, and phone number. Card details are entered into and processed by Shopify's secure checkout, including for phone orders. You give us this when you order. We use it to fulfill your order, process payment, arrange shipping, send confirmations and invoices, communicate with you, screen for fraud, and, based on your preferences, send you information about our products. It's shared with Shopify.
• Customer support information: Your name, address, phone number, and email address when you contact us. We use it to help you. It's shared with Shopify and Help Scout.

Payment security

Every page of our site, including checkout, is protected with SSL encryption; look for the lock icon in your browser's address bar. Card payments are handled by Shopify, which is certified PCI DSS Level 1, the highest level of the payment security standard required by Visa, Mastercard, American Express, and Discover. When you order online, your card number goes directly to the payment processor and is never stored on our systems. If you order by phone, our team enters your card directly into Shopify's secure system while you're on the line and never writes it down. We will never ask you to send card details by email or text message.

Who we share it with

We share personal information only with companies that help us run our store and serve you:

• Shopify powers our online store and checkout. Read Shopify's privacy policy.
• Klaviyo sends our emails and text messages.
• Help Scout manages our customer support messages.
• Advertising partners such as Meta, Google, and Microsoft, as explained below.
• Legal requests: We may share information to follow the law, respond to a subpoena, search warrant, or other lawful request, or protect our rights.

Advertising and pixels

Like most online stores, we use advertising and analytics tools, including the Meta (Facebook) pixel, Google Analytics, and Google and Microsoft Bing advertising. These tools use cookies and pixels to share information about your visits, purchases, and interactions with our ads with those companies. This helps us show relevant ads on Facebook, Instagram, Google, and other sites, and measure whether our ads work.

We do not sell your personal information for money. However, privacy laws in California and some other states define "selling" or "sharing" broadly enough to include this kind of advertising data. If you live in one of those states, you have the right to opt out, and we honor those requests.

You can opt out of targeted advertising in any of these ways:

• Meta (Facebook): Facebook ad settings
• Google: Google ad settings, or opt out of Google Analytics with the Google Analytics opt-out tool. See Google's privacy policy.
• Microsoft Bing: Microsoft personalized ads settings

How we use your information

We use your personal information to sell you products, process payments, ship and fulfill your orders, and keep you up to date on new products, services, and offers.

We will not share your text message opt-in with any third party for purposes unrelated to providing that messaging service. We may share your personal information, including your text message opt-in or consent status, with companies that help us deliver text messages, such as platform providers and phone companies.

Your rights

Wherever you live, you can ask us to show you, correct, update, or delete the personal information we hold about you. Email csfc@fashionablecanes.com.

• California residents: You have the right to know what personal information we hold, to receive a copy, to have it corrected or deleted, and to opt out of the sale or sharing of your information. You may designate an authorized agent to make requests for you by contacting us.
• European Economic Area (EEA) residents: Under the GDPR, you have the right to access your information, move it to another service, and have it corrected, updated, or erased. We process your information based on your consent, our contract with you, our legal obligations, your vital interests, tasks in the public interest, or our legitimate interests that do not override your rights. Your information is first processed in Ireland and then transferred to Canada and the United States. See Shopify's GDPR information. You may object to decisions made solely by automated means that significantly affect you.

Automated decisions

We do not use fully automated decision-making that has a legal or similarly significant effect on you. Shopify uses limited automated tools to prevent fraud, such as temporarily blocking IP addresses linked to repeated failed payments for a few hours, and the cards linked to those addresses for a few days.

How long we keep it

When you place an order, we keep your information for our records unless you ask us to delete it.

Children

The Site is not intended for children under 13, and we do not knowingly collect their information. If you believe your child has given us personal information, contact us and we will delete it.

Cookies

Cookies are small files saved to your device when you visit the Site. They remember things like your cart and login, and help us understand how the Site is used. Most expire between 30 minutes and two years after they're set. We also use cookies to know when a cart is left behind, which may trigger a cart reminder by text if you've signed up.

You can block or delete cookies in your browser settings, usually under "Tools" or "Preferences," or learn more at allaboutcookies.org. Blocking cookies may affect how the Site works and may not stop all sharing with advertising partners. To fully opt out, use the options in Advertising and pixels.

Do Not Track

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

In no case shall Fashionable, Inc., or our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any products obtained through it, or any other claim related to your use of the Service or any product, including errors or omissions in any content, or any loss or damage resulting from the use of the Service or any content or product made available through it, even if advised of the possibility. Obligations and liabilities incurred before the termination date survive termination of this agreement for all purposes. These Terms are effective unless and until terminated by you or us. You may terminate them at any time by notifying us that you no longer wish to use our Services, or by no longer using our site. Text Message Terms

The Fashionable Canes text message program (the "Program") is operated by Fashionable, Inc. By signing up, you agree to these terms. We may change or end the Program or these terms at any time, to the extent allowed by law. Continuing to use the Program after a change means you accept it.

• What you'll receive: Recurring automated marketing and service text messages from Fashionable Canes, such as order updates, cart reminders, promotions, and special offers, sent to the mobile number you provided. This applies even if your number is on a state or federal Do Not Call list.
• Optional: Signing up is never a condition of purchase.
• Frequency and cost: Message frequency varies. Message and data rates may apply. We don't charge for the Program, but your wireless provider may.
• How to stop: Text STOP to +1 (866) 504-2825 or tap the unsubscribe link in any message. You'll get one confirmation text, then no more messages unless you sign up again.
• Help: Text HELP to +1 (866) 504-2825 or email csfc@fashionablecanes.com.
• Number changes: We may change the number we text from and will let you know. Messages, including STOP or HELP, sent to a number we no longer use may not be received.
• New phone number: If you change your mobile number, sign up again with the new number.
• Delivery: Wireless carriers are not liable for delayed or undelivered messages. To the extent allowed by law, we are not liable for failed, delayed, or misdirected messages, errors in them, or actions taken based on them.
• Privacy: Your information is handled under our Privacy Policy. We never share your text message opt-in with third parties for their own marketing.

Fashionable Canes wants everyone to be able to use our website comfortably, including people with disabilities. We believe accessibility helps every visitor, and that everyone deserves to shop with dignity, comfort, and independence.

Our accessibility tools

fashionablecanes.com offers UserWay's accessibility widget to help the site meet the Web Content Accessibility Guidelines (WCAG 2.1). Ongoing improvements

We regularly scan the site with UserWay's accessibility scanner and work to fix the issues we find. Some content may not yet fully meet the strictest accessibility standards, and we keep improving as better solutions become available.
